General Terms and Conditions<\/h1><\/div>

1. Scope<\/strong>
\nThe\u00adse Gene\u00adral Terms and Con\u00addi\u00adti\u00adons (\u201cGTC\u201d) app\u00adly to the enti\u00adre busi\u00adness acti\u00advi\u00adties of Open Learning Space GmbH (her\u00adein\u00adaf\u00adter the \u201cCom\u00adpa\u00adny\u201d). The Com\u00adpa\u00adny offers home\u00adwork sup\u00adport for pri\u00adma\u00adry, lower secon\u00adda\u00adry and upper secon\u00adda\u00adry school stu\u00addents as well as pre\u00adpa\u00adra\u00adti\u00adon cour\u00adses for the ent\u00adrance exami\u00adna\u00adti\u00adons to Zurich grammar schools. <\/p>\n

2. Con\u00adclu\u00adsi\u00adon of contract<\/strong>
\nBy accep\u00adting the offer let\u00adter recei\u00adved or by sub\u00admit\u00adting the regis\u00adtra\u00adti\u00adon form, the legal repre\u00adsen\u00adta\u00adti\u00adve ack\u00adnow\u00adled\u00adges the Gene\u00adral Terms and Con\u00addi\u00adti\u00adons and the cur\u00adrent pri\u00adces. The con\u00adtract bet\u00adween the legal repre\u00adsen\u00adta\u00adti\u00adve and the Com\u00adpa\u00adny is con\u00adcluded upon writ\u00adten con\u00adfir\u00adma\u00adti\u00adon of the indi\u00advi\u00addu\u00adal tui\u00adti\u00adon and\/or cour\u00adse par\u00adti\u00adci\u00adpa\u00adti\u00adon by a repre\u00adsen\u00adta\u00adti\u00adve of Open Learning Space GmbH. In any case, the con\u00adtract is con\u00adcluded when the cus\u00adto\u00admer makes use of the ser\u00advices offe\u00adred by the Company. <\/p>\n

3. Pri\u00adces<\/strong>
\nAll pri\u00adces are in Swiss francs (CHF). The Com\u00adpa\u00adny reser\u00adves the right to adjust pri\u00adces. The pri\u00adces valid at the time the con\u00adtract is con\u00adcluded shall apply. <\/p>\n

4. Pay\u00adment<\/strong>
\nThe cus\u00adto\u00admer is obli\u00adged to pay the invoi\u00adced amount within 14 (four\u00adteen) days from the invoice date. If the invoice is not paid within the afo\u00adre\u00admen\u00adtio\u00adned pay\u00adment peri\u00adod, the cus\u00adto\u00admer will recei\u00adve a remin\u00adder. If the cus\u00adto\u00admer does not pay the invoice within the remin\u00adder peri\u00adod set, they will auto\u00adma\u00adti\u00adcal\u00adly be in default.
\nFrom the time of default, the cus\u00adto\u00admer owes default inte\u00adrest (5%) in accordance with CO 104.
\nThe Com\u00adpa\u00adny reser\u00adves the right to requi\u00adre advan\u00adce pay\u00adment at any time wit\u00adhout sta\u00adting reasons.
\nIn the event of late pay\u00adment, the Com\u00adpa\u00adny is entit\u00adled to refu\u00adse to pro\u00advi\u00adde the service. <\/p>\n

5. Can\u00adcel\u00adla\u00adti\u00adon \/ refund<\/strong>
\nA les\u00adson is con\u00adside\u00adred excu\u00adsed if the office has been noti\u00adfied 24 hours befo\u00adre the start of the les\u00adson; for tuto\u00adring on Mon\u00addays, the can\u00adcel\u00adla\u00adti\u00adon must reach the office by 9:00 AM at the latest. Unex\u00adcu\u00adsed les\u00adsons will be char\u00adged in full. <\/p>\n

Free tri\u00adal les\u00adson:<\/strong> Agreed tri\u00adal les\u00adson appoint\u00adments must be can\u00adcel\u00adled by the cus\u00adto\u00admer by pho\u00adne or email at least 6 hours befo\u00adre the appoint\u00adment; other\u00adwi\u00adse, an admi\u00adnis\u00adtra\u00adti\u00adon fee of CHF 60.- will be charged.<\/p>\n

Small group tuition:<\/strong><\/p>\n

Per les\u00adson packa\u00adge (10 les\u00adsons), 2 les\u00adsons may be missed wit\u00adhout an excu\u00adse. Any fur\u00adther missed les\u00adsons will be deduc\u00adted from the credit. <\/p>\n

Gym\u00adna\u00adsi\u00adum pre\u00adpa\u00adra\u00adti\u00adon courses:<\/strong><\/p>\n

The cour\u00adse fee is due befo\u00adre the start of the cour\u00adse and includes all cos\u00adts for tui\u00adti\u00adon and cour\u00adse mate\u00adri\u00adals. Missed les\u00adsons can\u00adnot be refun\u00added. Non-pay\u00adment of the cour\u00adse fee does not count as a can\u00adcel\u00adla\u00adti\u00adon. For can\u00adcel\u00adla\u00adti\u00adons up to two weeks befo\u00adre the start of the cour\u00adse at the latest, a pro\u00adces\u00adsing and reser\u00adva\u00adti\u00adon fee of CHF 200.00 will be char\u00adged. If the can\u00adcel\u00adla\u00adti\u00adon is made later, the full cour\u00adse fee is due. If the num\u00adber of par\u00adti\u00adci\u00adpan\u00adts is too small, group cour\u00adses may be can\u00adcel\u00adled. The cour\u00adse fee will be refun\u00added in full. <\/p>\n

6. Ter\u00admi\u00adna\u00adti\u00adon<\/strong>
\nFor important reasons, the Com\u00adpa\u00adny may ter\u00admi\u00adna\u00adte the con\u00adtract wit\u00adhout obser\u00adving a noti\u00adce peri\u00adod. Important reasons include serious disci\u00adpli\u00adna\u00adry offen\u00adces, cri\u00admi\u00adnal\u00adly rele\u00advant beha\u00adviour, serious brea\u00adches of the house rules and dis\u00adrup\u00adti\u00adon of school ope\u00adra\u00adti\u00adons. In the event of ter\u00admi\u00adna\u00adti\u00adon by the Com\u00adpa\u00adny, the\u00adre is no entit\u00adle\u00adment to a refund of tui\u00adti\u00adon fees alre\u00ada\u00addy paid. <\/p>\n

7. Obli\u00adga\u00adti\u00adons of the Company<\/strong>
\nThe Com\u00adpa\u00adny gua\u00adran\u00adtees the pro\u00advi\u00adsi\u00adon of the agreed ser\u00advice by sel\u00adec\u00adted tutors. Sub\u00adsti\u00adtu\u00adte tutors may be used if required. <\/p>\n

8. Warranty\/liability<\/strong>
\nThe Com\u00adpa\u00adny war\u00adrants to per\u00adform the agreed ser\u00advices to the best of its know\u00adledge and belief. Howe\u00adver, no gua\u00adran\u00adtee is given that aca\u00adde\u00admic suc\u00adcess will be achieved.
\nAny lia\u00adbi\u00adli\u00adty for auxi\u00adlia\u00adry per\u00adsons is excluded in full. For dama\u00adge to per\u00adsons and\/or pro\u00adper\u00adty cau\u00adsed by the stu\u00addent on the way to school or in or at the school, the legal repre\u00adsen\u00adta\u00adti\u00adve of the stu\u00addent is sole\u00adly and ful\u00adly liable. <\/p>\n

9. Insu\u00adrance<\/strong>
\nFor all offers of the Com\u00adpa\u00adny, the legal repre\u00adsen\u00adta\u00adti\u00adve is respon\u00adsi\u00adble for ensu\u00adring ade\u00adqua\u00adte insu\u00adrance covera\u00adge for the stu\u00addent. The Com\u00adpa\u00adny is not lia\u00adble for theft or loss of items. <\/p>\n

10. Data protection<\/strong>
\nThe Com\u00adpa\u00adny may pro\u00adcess and use the data coll\u00adec\u00adted in the cour\u00adse of con\u00adclu\u00adding the con\u00adtract in order to ful\u00adfil the obli\u00adga\u00adti\u00adons ari\u00adsing from the con\u00adtract. The Com\u00adpa\u00adny takes the mea\u00adsu\u00adres requi\u00adred to secu\u00adre the data in accordance with the sta\u00adtu\u00adto\u00adry provisions. <\/p>\n

11. Amend\u00adments<\/strong>
\nThe\u00adse Gene\u00adral Terms and Con\u00addi\u00adti\u00adons may be amen\u00added by the Com\u00adpa\u00adny at any time.
\nThe new ver\u00adsi\u00adon shall enter into force 30 (thir\u00adty) days after being published on the web\u00adsite by the Company.
\nFor cus\u00adto\u00admers, the ver\u00adsi\u00adon of the GTC that is in force at the time the con\u00adtract is con\u00adcluded shall gene\u00adral\u00adly apply.<\/p>\n

12. Appli\u00adca\u00adble law \/ place of jurisdiction<\/strong>
\nThe\u00adse GTC are sub\u00adject to Swiss law. Unless man\u00adda\u00adto\u00adry sta\u00adtu\u00adto\u00adry pro\u00advi\u00adsi\u00adons take pre\u00adce\u00addence, the court at the Company\u2019s regis\u00adtered office shall have jurisdiction. <\/p>\n
